The website accessible at the url address www.indulgente.fr (hereinafter the "Site") is owned and published by the company INDULGENTE PARIS, a simplified joint-stock company with a single shareholder with a capital of 1000 euros, registered in the Register of Commerce et des Sociétés de Paris under number 900863044, whose registered office is located at 61 rue de Lyon, 75012 Paris (hereinafter “Indulgente”).

2. ACCOMMODATION

The Site is hosted by WIX.COM LTD, a foreign company registered with the RCS under number 808 452 825, whose head office is located at 40 PORT DE TEL AVIV  TEL AVIV JAFFA 6350671).

 

3. ACCESS TO THE SITE AND CHANGES TO THE CONTENT

By accessing or using the Site, you acknowledge having been informed of the existence of these Terms of Use, you accept them and undertake to comply with them. If you disagree with these Terms of Use, Indulgent invites you to leave the Site immediately.

 

Indulgente reserves the right to refuse access to all or part of the Site to any user who does not comply with the Terms of Use.

At no time does Indulgente undertake to provide continuous access to the Site free of any malfunction. Malfunctions designate all technical difficulties, all IT difficulties, all difficulties related to the structure of communication networks and all cases of force majeure. These malfunctions can also be justified by maintenance. The user of the Site accepts that these possible difficulties arise by connecting. Damage resulting from access to and circulation on the Site shall not engage the liability of Indulgente.

Indulgente reserves the right to modify or correct, at any time and without notice, the contents of the Site, whatever their nature.

Indulgente reserves the right, at its sole discretion and without prior notice, to modify, delete or add clauses to the Terms of Use of the Site. Users are therefore advised to regularly refer to the latest version of these Terms of Use. If you continue to use this Website after these Terms of Use are amended, you are deemed to have consented to the revised Terms of Use.

4. INTELLECTUAL PROPERTY

With regard to national and international provisions on copyright, trademark law and, in general, intellectual property law, the Site and its contents (in particular graphics, images, texts, logos and form) are, and remain, even after downloading, the exclusive property of Indulgente and/or natural or legal persons having granted it assignments and/or operating licenses on these intellectual property rights.

Consequently, the possible reproduction of any element of the Site and/or any content published on the Site must be authorized, except for private and free use of the copyist in a family circle.

Any other use, copy, reproduction, representation, distribution, translation or adaptation, in whole or in part, of an element or content published on the Site, on any medium whatsoever and by any process whatsoever, is prohibited, except with the prior written consent of Indulgente.

Any unauthorized reproduction constitutes an act of infringement, punishable by articles L335-2 and following of the Intellectual Property Code.

The hypertext links present on the Site can direct you to external sites whose content cannot in any way engage the responsibility of Indulgente.

6. PRIVACY AND PERSONAL DATA PROTECTION POLICY

This privacy policy (“Privacy Policy”) is intended to inform you about how the personal information that you provide to Indulgente, on the Site, in our stores, or by any other means, is treated.

Indulgent recognizes the importance of ensuring the protection and security of your privacy and personal information, and has established this Privacy Policy in accordance with the strictest criteria for the protection of personal data, as well as any applicable regulations.

As such, Indulgente complies with Law No. 78-17 of January 6, 1978 as amended, known as the “Data Protection Act” and Regulation (EU) No. 2016/679 of the European Parliament and of the Council of April 25, 2016, known as “GDPR” (together hereinafter referred to as the “Applicable Regulations”).

The Privacy Policy is applicable to all users of the Site and/or customers of Indulgente. We invite you to read the content carefully. If you disagree with the terms of this Privacy Policy, please do not provide any personal information about yourself and stop using the Site. When communicating your personal data, you must accept, by ticking the box provided for this purpose, their collection, storage and processing by Indulgente under the terms and conditions of this Privacy Policy.

You also have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent made prior to such withdrawal.

This Privacy Policy may be modified by Indulgente at any time and without notice, in particular due to normative changes. The new Privacy Policy will apply from the date it is posted on the Site.

 

6.1. Information collected by Indulgente

The information about you that may be collected and processed by Indulgente is:

·      as part of creating an account on the Site or if you complete our form in one of our stores, your identification and contact information, such as your name, gender, date of birth, address, address email, password and phone number,

·      if you contact Indulgente, a record of this correspondence may be kept,

·      information relating to your visits to our stores and/or the Site and to the use of our services that you make.

 

6.2. Uses of information

Indulgente uses the personal information you provide to it to:

·      create your account on the Site and allow you access to this account,

·      communicate to you the information, products and/or services that you request or that may be of interest to you, when you have consented to be contacted for this purpose,

·      inform you of any changes made to the Site.

Indulgente does not market, rent or disclose your personal information to third parties other than companies belonging to its group or an administrative or judicial authority that would have given it an order.

6.3. The duration of the conversation

The personal data collected on the Site is kept for a limited period and in a manner strictly necessary and proportional to the pursuit of the purposes identified in this Privacy Policy, namely for 3 years following the last connection to the Site and/or the last contact with Indulgent.

 

6.4. Security

Indulgente employs all appropriate security measures to ensure the protection of information about you, in accordance with this Privacy Policy and the requirements of the GDPR.

In particular, Indulgente takes all necessary precautions with regard to the nature of the personal data communicated to it and the risks presented by their processing, in order to preserve their security and in particular to prevent them from being distorted, damaged, or that third parties not authorized have access.

 

6.5. Transfer of personal data

Indulgente and/or its affiliates (i.e., any entity, company controlling, controlled by Indulgente or under control with it, control being defined by Articles L.233-1 and L.233-3 of the Code de commerce) do not transfer personal data to a State that is not a member of the European Union or the European Economic Area.

 

6.6. Personal Data Breach

Indulgente will inform you as soon as possible of any breach of your personal data likely to create a high risk for your rights and freedoms, in accordance with Articles 33 and 34 of the GDPR.

 

6.7. Subcontracting

Indulgente undertakes to use subcontractors with sufficient guarantees as to the implementation of appropriate technical and organizational measures so that the processing of personal data meets the requirements of the GDPR.

If applicable, the processing of personal data carried out by a subcontractor is governed by a contract concluded between the latter and Indulgente and/or one of its affiliates (i.e., any entity, company controlling , controlled by the Company or under control with it, control being defined by Articles L.233-1 and L.233-3 of the Commercial Code), in accordance with Article 28 of the GDPR.

 

6.8. Cookies

A cookie is a data file placed on your computer or other device when it is used to visit the Site.  Indulgente uses cookies to find out which pages of the Site are visited and how often, in order to make it more user-friendly and offer you adapted and personalized services the next time you visit the Site.

You are informed by the appearance of a banner that a cookie can be installed automatically on your navigation software during your visits to the Site, as well as their purposes.

By accepting cookies, you consent to the use of personal information in connection with the technologies as described in this Privacy Policy.

The cookies used by the Site are only associated with anonymous users and their computer and do not provide references from which to deduce users' personal data.

Some cookies are used by third parties (e.g. Google) to transmit to  Forgiving data on the effectiveness of its promotions. Cookies do not, under any circumstances, obtain personal information that could identify a particular user.

In this sense, Indulgente assumes no responsibility for the content or practices of linked sites. 6.9. Rights

In accordance with the Applicable Regulations, you have the right to access, rectify and delete personal data concerning you.

In addition, you have the right to oppose the processing of your personal data, for reasons relating to your particular situation, as well as the right to request the limitation of the processing of personal data carried out by the Company.

Indulgent is committed to processing all requests as soon as possible.

You also have the right to lodge a complaint with the National Commission for Computing and Liberties (CNIL).

 

7. DISPUTE RESOLUTION

Any complaint concerning the Site or one of the products offered on the Site must be reported by email to the address contact@indulgente.fr or by registered letter with acknowledgment of receipt to the following postal address: INDULGENTE SAS, 61 rue de Lyons 75012 Paris.

Indulgente will do its best to process this request and reach a resolution of the dispute in accordance with the interests of the parties.

8. SEVERABILITY

If any of the stipulations of these Terms of Use and the Privacy Policy were to be canceled or declared inapplicable, in part or in whole, under the laws and regulations in force, it will be excluded from these Terms of Use. 'Use and Privacy Policy without affecting the validity and enforceability of all of its other terms.

9. APPLICABLE LAW - JURISDICTION

These Terms of Use of the Site and Privacy Policy are subject to French law.

Indulgente and the user first undertake to find an amicable solution to resolve any disputes that may arise between them. If they cannot find common ground, the courts of the FEVAD e-commerce Mediator may, under these conditions, be seized to find a solution to the dispute.

The European Commission provides an online dispute resolution (OS) platform. This platform is available at http://ec.europa.eu/consumers/odr/ . As a customer, you always have the option of contacting the arbitration board of the European Commission. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
